Change An Entry In The Register Of Judgments Orders And Fines

You might be able to get your entry in the Register changed before the 6 years is up if you pay the debt off more than a month after the date of the CCJ.

You’ll need to prove to the court that youve paid the debt and then get a certificate from them. Youll have to pay for the certificate but the fee can be waived or reduced if youre on a low income.

A note will be made against your entry on the Register to show that the debt has been satisfied, or paid.

If your entry on the Register is changed, the credit reference agencies will be told that youve paid your debt. The CCJ will still stay on your credit report until the 6 years is up but your record will show that youve paid the debt.

You might find it easier to get credit when your record has been changed.

Avoid credit repair companies

You should avoid credit repair companies who claim to clear debt records.

They charge high fees and sometimes get people to lie to try and clear their debt records – which probably wont be possible anyway.

Under the Fair Debt Collection Practices Act , a bill collector may still contact you on a lapsed judgment and ask you to pay. However, a debt collector can’t threaten to garnish your wages or take other legal action to pressure you into settling that old judgment. If a debt collector lies to you about the age of the judgment and whether it lapsed under your state’s laws, that also might be a violation of the FDCPA.

Why Are Judgments And Tax Liens No Longer On Credit Reports

In 2015 the three major credit bureaus Equifax, Experian, and TransUnion made a settlement with 31 state attorneys general. The settlement brought about an agreement now known as the National Consumer Assistance Plan, NCAP for short.

NCAP triggered a series of policy changes the credit bureaus agreed to implement in order to make credit reporting more accurate. Some of those changes had to do with the way the credit bureaus collected and reported public record data.

Although tax liens and judgments might not appear on your credit reports today, there are still plenty of reasons to avoid them.

Its true you probably didnt wake up one morning and decide you were no longer going to pay your bills. Thats not the way financial and credit problems start for most people.

Still, even if youre struggling with bills you cant pay, you can avoid many tax liens and judgments simply by communicating with the agency or company to whom you owe the debt. The IRS, for example, offers payment plans for taxpayers who cant afford to pay their tax bills in full. Your creditors might be willing to settle your debt for less, as well.

One fact is clear. When youre in over your head financially, ignoring your problems isnt the answer.

Talk to your creditors or consider getting legal help or credit counseling. In extreme cases, bankruptcy might be your best option.
